Applicable Law 1. REGISTRATION AND ON-LINE ACCOUNT
1.1 To place an order through the dunhill On-Line Store You will need to register and open an account. To do this, go to the registration page, click on the "new customer" register button and complete the registration process.
1.2 On registration, Customers will be asked to choose a password and account login. Please note that Customers are responsible for ensuring that their password and account login are kept safe and secure at all times. Alfred Dunhill will not be held responsible for any misuse of Your account in the event that a third party has access to Your password and account login.
Back to top2.1 To place an order, You must be over 18 and lawfully capable of entering into and forming a valid contract in accordance with English law.
2.2 Products are exclusively available for sale through the dunhill On-Line Store to end-user Customers only and are not for re-sale. Consequently, Alfred Dunhill reserves the right to refuse orders placed by Customers who breach this condition. Furthermore, in the event that Alfred Dunhill, at its entire discretion, reasonably suspects that a Customer has breached this condition, the Customer's password and account login will be cancelled and the account will be automatically terminated.
2.3 In order to make purchases through the dunhill On-Line Store, You will need to create an online account and You will be requested to provide information about Yourself as indicated so that We may process Your Order. You represent and warrant that the information provided by You is both valid and correct.
2.4 You further represent and warrant that the data You provide will not contain any computer viruses, macro viruses, Trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority or expropriate any system, data or personal information; nor will such data cause the dunhill On-Line Store to be interrupted, damaged, rendered less efficient or in any other way compromised such that the effectiveness or functionality of this website is in any way impaired.
2.5 Once You have chosen an item, click on the image to access the product page where information on the item, such as prices, sizes and colour options will be displayed.
2.6 If You are happy with Your choice, click on the "Add to Basket" button.
2.7 You can monitor the product(s) You have chosen by clicking on the "Shopping Basket" button at any time. You can also remove an item by clicking on the "Remove" button next to the chosen product.
2.8 When You are ready and have reviewed Your order, proceed to "Checkout" and follow the instructions. You will be required to enter Your payment details. When You have completed this process, please click on the "Purchase" button.
2.9 All prices shown in the dunhill On-Line Store are in local currency, that is US Dollars, Sterling or Euros.
2.1 Prices displayed for products to be delivered to France and the United Kingdom include local VAT as applied to consumers in those countries.
2.11 Prices displayed for products to be delivered to Belgium, Channel Islands, Germany, Ireland, Italy, Luxembourg, Netherlands and Spain include VAT at the UK rate.
2.12 Prices displayed for products to be delivered to the USA do not include local Sales Tax. However, Your State and/or municipal government may require You to declare Your Internet purchases and pay Sales, Use or other applicable Tax on them directly.
2.13 Delivery costs are not included and will be displayed on the order form once You have completed Your selection.
2.14 You should carefully check all details prior to confirming Your order.
2.15 Once You have confirmed Your order, We will issue You with an Alfred Dunhill Order Reference Number, which will appear in Your order confirmation. Please make sure that You save this number for reference.
2.16 On placing an order through the dunhill On-Line Store, You are making an offer to Us to purchase the products selected in accordance with these Terms. (Please note that We may not always be able to accept Your offer; please see details of Acceptance in section 4)
2.17 Please note that, by making an offer to purchase merchandise, You hereby expressly authorise Alfred Dunhill and/or its online service partners to perform the appropriate credit checks for Us and, should it appear necessary, obtain additional information required to process Your order efficiently. Information received or sent to authorised third parties may include, but is not limited to Your name and credit card details. This may be necessary to authenticate Your identity, to validate Your payment card, to obtain an initial credit card authorisation and to authorise individual purchase transactions (please see Our Privacy Policy in section 9).

3.1 The dunhill On-Line Store is only available to On-Line shoppers who meet Our terms of eligibility, in particular, individuals who are over 18, have been issued with a valid payment card by a reputable bank and who have agreed and authorise Alfred Dunhill to process a charge or charges on their payment card in the amount of the total purchase price for the products they choose to purchase (see Payment in section 5).

Back to top 4. ACCEPTANCE
4.1 Once Your order has been submitted through the dunhill On-Line Store, Alfred Dunhill will send You an e-mail confirming Your order. A second e-mail will be sent informing You of the dispatch date of Your order.
4.2 Unless You cancel Your order in accordance with Our Cancellation Policy (see section 7), acceptance of Your order and completion of the contract between You and Alfred Dunhill will take place when We dispatch the item(s) to You. The sale contract is therefore concluded at that time in London, England and the language of the contract is English.
4.3 We reserve the right not to accept Your order. Such non-acceptance may result, for example, from the fact that the item ordered is out of stock or that We are unable to obtain authorisation for Your payment or that You do not meet the terms of eligibility as set out in section 3 above.
4.4 Furthermore, We retain the express right not to process a transaction at any time at Our sole discretion for whatever reason. In this event, We will not be liable to You or any third party by reason of Our not accepting Your order or withdrawing any merchandise from the dunhill On-Line Store, whether or not such item(s) have been sold.

5.1 We accept the following major payment cards only: MasterCard, Visa, Switch, American Express, Solo and Delta. Payment will be debited from Your account upon receipt of Your order by Alfred Dunhill. You are responsible for confirming that You are the legitimate holder of the credit/debit card and that Your details are correct. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer.
5.2 If the issuer of Your payment card refuses to authorise payment to Alfred Dunhill, We will not be able to process Your order and a message will appear informing You that the transaction cannot be processed.
5.3 Alfred Dunhill, together with its partners, takes all reasonable care to make the dunhill On-Line Store as secure as they can. All payment card transactions made through the dunhill On-Line Store are processed by HSBC (see 5.6 below) using their secure online payment gateway (see below) that encrypts Your card details in a secure hosting environment. We do not hold Your payment card details on the Alfred Dunhill server.
5.4 To help ensure that Your shopping experience is safe, simple and secure, Alfred Dunhill uses Secure Socket Layer (SSL) technology. This encrypts and protects the personal and payment data You send to Us over the internet. When SSL is enabled, You will see a padlock at the bottom of Your browser and You can click on this to find out information about the SSL digital certificate registration.
5.5 We will employ all reasonable care to ensure that details of Your order and payment are held securely. However, We cannot be held liable for any loss You may suffer if a third party procures unauthorised access to any data You provide when accessing or ordering from dunhill's On-Line Store.
5.6 You are informed that HSBC may store or transmit information relating to You within the HSBC Group through the HSBC Group's proprietary international telecommunications network or other communications networks. HSBC stores transactional data outside of the European Union. Accordingly, they declare that their service will comply with all the Data Protection legislation and where applicable the Electronic Communications Regulations 2003 and any modifications thereof (please also refer to Our Privacy Policy).

6.1 At the present time, We only dispatch and deliver orders from the dunhill On-Line Store to the following countries:

United Kingdom (including Northern Ireland and the Isle of Man)

6.2 All products are delivered from Our warehouse in the UK. Deliveries are charged in addition to the cost of the products themselve. The cost of delivery is calculated based on the country of delivery and the content of Your shopping basket. The delivery charges are fixed per order and do not increase if You add more products to Your basket:

6.3 Pens and lighters refills are sent through registered post. Deliveries may take a week or more.
6.4 For all products except pens and lighters refills, dunhill uses DHL standard delivery services to deliver products to You.
6.5 Your order will be shipped once the payment has been approved and the address has been verified.
6.6 Europe. If received before 12 noon (UK Time) the expected DHL delivery time for Your order is one (1) day for the following countries:

6.7 For orders received after 12 noon (UK time) and before16.00 (UK time) We will use Our best endeavours to ensure delivery within the next two (2) working days.
6.8 However, if You live in Italy, Northern Scotland or in a more remote area of one of the aforementioned countries deliveries may take one or two days longer.
6.9 United States. If received before 12 noon (UK Time), DHL expected transit time for Your order is two (2) working days.
6.1 For orders received after 12 noon (UK Time) and before 16.00 (UK time) delivery may take three (3) working days and if You live in a remote area one or two additional days.
6.11 The delivery times shown above are based on DHL expected transit times but cannot be guaranteed. Furthermore, We cannot be held accountable for delays in Customs clearance.
6.12 Item(s) will be delivered to the delivery address as shown in Your Order Confirmation.
6.13 You will receive an e-mail notifying You of the date of dispatch of Your order and once dispatched You will be able to track it On-Line through the DHL website available at http://track.dhl.co.uk/tracking using Your unique DHL delivery reference number.
6.14 You will need to ensure that someone is present at the given delivery address to sign for the order when it is delivered.
6.15 Alfred Dunhill insures each purchase during the time it is in transit until it is delivered to You. You will be asked to sign for any item(s) delivered, at which point all responsibility and risks for Your purchased item(s) pass to You.
6.16 Alfred Dunhill will store a record of Your transactions for a minimum period of one year. Please note that for Your security We only retain records of Your transactions on the Alfred Dunhill Web Site; Your payment card details are neither held on the Alfred Dunhill Web Site nor on the dunhill On-Line Store.

7.1 Your satisfaction is Our number one priority.

7.1.2 Alfred Dunhill Customer Services will supply You with a Returns Authorisation Form number (RAF) and full instructions. You should retain the RAF number as a record.

7.2 Cancellations and "cooling off” period.
7.2.1 If You wish to cancel Your order, You are entitled to do so within fourteen (14) days following delivery of the item(s) and obtain a full refund of the purchase price of the delivered item(s). Alfred Dunhill will arrange pick up and pay the transportation costs for the order cancellation events listed in 7.7 below.
7.2.2 Please be aware that sometimes it will not be possible to stop a cancelled order from being dispatched, because We endeavour to process orders on the same day. If Your order has already been fully processed and dispatched, please follow the returns policy.
7.3 Cancellation and returns following delivery.
If You are not happy with the item(s) delivered You may either:
7.3.1 Cancel Your order. In accordance with the aforementioned cancellation and "cooling off" period, the cancellation period commences as of the date You receive Our e-mail acknowledging acceptance of Your order and ends on the fourteenth day following receipt of the merchandise by You or, in the case of gifts, the person who received them.
7.3.2 Exchange an item for a different item.
7.3.3 Return the item
7.4 Returns, exchanges and cancellations
7.4.1 In the event of returns, exchanges or cancellations, We require that You return any item(s) to Us in their original packaging in a "new and unused state" with all original labelling attached and a copy of the invoice.
7.4.2 PLEASE NOTE: "New and unused" means that there are no marks on the item(s) or any wear on the tags. We do not sell used item(s) and will not accept any item with any indication that it was used or, in the case of belts, cut to size. All item(s) will be subject to a Quality Control (QC) check on return receipt. If item(s) do not meet QC standards then the item(s) will be returned to the purchaser at the purchaser's cost.
7.5 All returns, exchanges and cancellations will only be accepted with a RAF number (please refer to section 7.1.1 above for details of how to obtain a RAF number).
7.6 It is the Customer's responsibility to ensure that any goods being returned are fully insured whilst in transit to Alfred Dunhill.
7.7 Although We make every effort to ensure that You receive the item(s) ordered, please let Us know if this is not the case. We offer a free returns process using DHL in the event that:
a) The item(s) is not what was ordered.
b) The item(s) is flawed.
c) You have changed Your mind and wish to cancel Your order during the cooling off period outlined in section 7.2 above (this does not apply to orders sent as a gift please see Our gift policy in section 8)
7.8 In all other cases shipment and insurance of item(s) returned, cancelled or exchanged is the responsibility of the sender and this will be at their cost. We require that item(s) be returned within thirty (30) days of the date of delivery of the item(s).

7.10 In the event of any failure to return any item(s) to Us as set out in these Terms within the stipulated time limits, even though validly cancelled, We shall have the right to charge any costs relating to the recovery of the item(s). 7.11 Refunds to You will be made within 30 days of the date of cancellation notice provided that the goods are properly returned. All undamaged, correctly returned items will be credited to the original purchaser's payment card including VAT but excluding shipping charges and recovery costs. We do not offer Alfred Dunhill store credits.
7.12 Alfred Dunhill will not issue credit notes for use through the dunhill On-Line Store or in Alfred Dunhill stores/stockists.
7.13 Items purchased through the dunhill On-Line Store cannot be exchanged or refunded in Alfred Dunhill stores/stockists.

8.1 If the item(s) ordered from the dunhill On-Line Store is a gift ("Gift") and the recipient wishes, for example, to exchange an item for a different item, he/she may return the Gift at any time during the thirty (30) days from the day after he/she receives the item(s). His/her right to return item(s) is subject to compliance with Our Returns policy outlined in section 7 above.
8.2 The person having received the Gift may exchange the item(s) for another one of the same value or more provided they pay the price difference together with any additional shipping costs.
8.3 Alfred Dunhill will not issue credit notes for Gifts for use through the dunhill On-Line Store or in Alfred Dunhill stores/stockists.
8.4 Gifts that were purchased through the dunhill On-Line Store cannot be exchanged or refunded in Alfred Dunhill stores/stockists.

9.1 The dunhill On-Line Store is committed to protecting the privacy of its Customers by providing a secure On-Line Store for electronic commerce transactions and is registered to hold personal data under the Data Protection Act 1998.
9.2 Children under the age of 18 should not send any information about themselves and should not register with the On-Line Store or to receive further information from Alfred Dunhill Ltd. Should We discover or be informed that a child has registered his/her personal details, We will delete such information.
9.3 Note to Parents. Alfred Dunhill will not intentionally collect personally identifiable information from children under the age of 18. If, as a parent, You wish to find out if Your child has registered for one of Our services, or wish to cancel Your child's registration, please contact Us at customer.services@dunhill.com.
9.4 When ordering products from the dunhill On-Line Store, You will be asked to provide personal information including Your name, delivery address, telephone number, product selections as well as payment card details ("Personal Information"). Any Personal Information you make available to Alfred Dunhill is done so voluntarily, with Your knowledge and consent when ordering items or registering for services from Alfred Dunhill. Registration forms contain both mandatory fields (indicated with an asterisk (*)) and non-mandatory fields; if You choose not to complete the mandatory fields then Alfred Dunhill may not be able to respond to Your request or activate Your option choices.
9.5 Personal Information provided by You will be used to process Your orders and will be made accessible to duly authorised Alfred Dunhill personnel and occasionally to persons or companies who carry out internal operations in relation to Our business. Your Personal Information is collected with Your knowledge and express authorisation upon opening a dunhill On-Line Store account. Consequently, some of this information will be shared with Our On-Line business partners and, in particular, HSBC, DHL, Kuehne-Nagel and, if You have activated options to receive further communications from Alfred Dunhill, Our CRM partner Prestige.
9.6 Whilst Alfred Dunhill has taken all reasonable precautions to ensure that its On-Line business partners will handle your Personal Information in a secure and proper manner, Alfred Dunhill cannot be held responsible for the failure by any of such partners to deal with Your Personal Information in accordance with its legal obligations. Consequently, Customers are advised that they may wish to refer to these companies' and their credit card companies' policies in relation to the protection of their Personal Information since they may use other members of their respective companies and/or third parties (in jurisdictions where there may be less stringent data protection laws) to process information on their behalf in relation to their credit card transactions.
9.7 Personal Information provided by You at the time of making an order may also be used by Us and by HSBC to check details with fraud protection agencies. Furthermore Your Personal Information will be used by HSBC to process payment of the order, handle credit checks and fraud prevention and by DHL to ensure proper delivery.
9.8 Furthermore, if You have activated the consent box, Your Personal Information will be used to send You information on Our products, promotions and events We feel may be of interest to You and may be used for marketing research purposes relating to Alfred Dunhill's business. It will not be used for any unsolicited communications to You unless so authorised. Alfred Dunhill will use its best endeavours to ensure that such Your Personal Information is kept secure at all times. Other than to its business partners as set out above, Alfred Dunhill does not sell, rent or otherwise make available any Personal Information relating to its online Customers to other third parties unless to its legal advisors or if required to do so by law. Upon request, Alfred Dunhill will remove Your Personal Information from its database thereby cancelling Your online account.
9.9 You may access Your account details via the dunhill On-Line Store using Your password and account login and correct any erroneous information concerning Your Personal Information. Furthermore, You are solely responsible for maintaining and updating Your personal details and ensuring that this information is current and complete.
9.10 We use cookies to help keep track of Your current shopping session and shopping basket content. If You do not accept cookies, You will not be able to use the On-Line Store.

11.1 Our total liability to You arising out of or in connection with any act or omission of Alfred Dunhill (whether occasioned by the negligence of Alfred Dunhill or its employees or agents or otherwise) relating to the supply of the products in Your order or their use by any consumer or other person, will be limited to the total of sums paid by You in the relevant order for the products in relation to which the liability has arisen; and Alfred Dunhill will not be liable to You for any damages resulting from any loss of profits, loss of goodwill or loss of business, costs, expenses or for any special, incidental, indirect or consequential loss or damage (whether in an action in contract or tort, and whether occasioned by the negligence of Alfred Dunhill or its employees or agents or otherwise) arising out of or in connection with any act or omission of Alfred Dunhill relating to the supply of the relevant products or their use by any customer, consumer or other person. Nothing in this section 11 shall exclude or limit the liability of Alfred Dunhill for death or personal injury caused by it's negligence, or for fraudulent misrepresentation.

12.1 These Terms shall be governed by and construed in accordance with the laws of England and Wales without regard to its conflict of law provisions and any dispute will be subject to the exclusive jurisdiction of the English courts in London.
12.2 Alfred Dunhill reserves the right to make changes to these Terms, notably in line with any revised legislation. Please check back from time to time to ensure You are aware of any changes in Our Terms. Your continued use of Our site will signify Your acceptance of these changes.
